Arash Ganji’s Forced Transfer To Rajaei-Shahr Prison In Karaj

Human Rights in Iran – Wednesday, August 31, 2022 – Arash Ganji, a political prisoner incarcerated in Evin Prison, was transferred to Rajaei-Shahr Prison without notice.

According to the report of Human Rights in Iran, before noon today, Wednesday, August 31, 2022, Arash Ganji, a writer, translator and political prisoner imprisoned in Ward 8 of Evin Prison, was transferred to Rajaei-Shahr Prison in Karaj, without prior notice. Arash Ganji is serving his 5-year prison term.

“Before noon today, Arash Ganji was transferred to Rajaei-Shahr Prison in Karaj under the pretext of being summoned to the Ward 8 administrative unit, while he was not informed in advance. This transfer has been met with a mass protest of political prisoners imprisoned in Ward 8.”, an informed source told the reporter of Human Rights in Iran.

This literary activist was summoned to serve his imprisonment on October 15, 2021, after receiving a notice from the 1st Branch of the Evin Prison Prosecutor’s Office and on November 1, 2021, after referring to that judicial unit, he was arrested and transferred to Evin Prison.

It should be noted that Arash Ganji was tried by Branch 28 of Tehran’s Revolutionary Court, headed by Mohammad Reza Amouzad, on December 28, 2020 and was sentenced to 5 years in prison on December 30 (2020), on the charge of “assembly and collusion with the intention of acting against national security”. Also, he was sentenced to 1 year of imprisonment for the charge of “propaganda activity against the regime” and 5 years in prison on the charge of “membership and cooperation with a group against the regime”. This sentence was upheld in the appeals court of Tehran Province and Arash Ganji’s case was referred to the enforcement branch of the Evin Prison Prosecutor’s Office.

This literary activist appeared in branch 28 of the Tehran Revolutionary Court on June 14, 2020. With the beginning of the proceedings and at the end of that hearing, the amount of bail increased from 450 million Tomans to 3 billion Tomans.  He could not provide that amount, as a result of which he was arrested and transferred to Evin prison. On June 20, 2020, he was released after depositing a new bail.

On December 22, 2019, following the raid of “Security Police” officers on Arash Ganji’s personal home in Tehran and the search of the home and the confiscation of his personal belongings, he was arrested. After 5 days, he made a phone call to his family and announced that he was in Security Ward 209 of the Ministry of Intelligence in Evin Prison and was being interrogated.

After completing the interrogation process, being aware of his accusation and enduring 29 days in solitary confinement, Arash Ganji was temporarily released on January 19, 2020, by posting a bail in the amount of 450 million Tomans, pending the completion of the proceedings.

Gani is the translator of books such as «Twilight of the gods over the new world order», «The struggle over the mode of thinking in the working class movement», «Killing A Mouse On Sunday», and several other books.

In Article 5 of the Criminal Procedure Law, it is emphasized on informing the defendant as soon as possible about the alleged charges and providing the right of access to a lawyer and other defense rights mentioned in the law.

Filing cases against labor and trade union activists violates Article 19 of the Universal Declaration of Human Rights and Article 19 of the International Covenant on Civil and Political Rights adopted on December 16, 1966, which emphasizes the right of individuals to express political and ideological thoughts and opinions without border restrictions.

Arbitrary detention and inaccessibility of individuals to lawyers violates Article 9 of the Universal Declaration of Human Rights and Article 9 of the International Covenant on Civil and Political Rights adopted on December 16, 1966.

The right to due process is one of the inalienable rights, which is also highlighted in Article 10 of the Universal Declaration of Human Rights.
