Definite Conviction of four civil activists to overall 40 years imprisonment for signing the declaration of the resignation of Ali Khamenei
Human Rights in Iran – On March 29th, 2020 branch 35 of the Razavi Khurasan Appeal Court has issued a sentence according to which Mohammad Nourizad, Hashem Khastar, Mohammad Hossein Sepehri, and Fatemeh Sepehri are convicted to overall 40 Years and 4 months of imprisonment. Also, as complementary punishment each of them sentenced to 2 years exiled and also 2 years banned from traveling out of Iran. The sentence was delivered to their lawyer in Razavi Khurasan.
According to reports by Human Rights in Iran, Sunday, March 29th, 2020 which Mohammad Nourizad, Hashem Khastar, Mohammad Hossein Sepehri, and Fatemeh Sepehri four civil activists and singers of the open letter and declaration to Ali Khamenei to resign also known as the 14-civil-activists declaration was sentenced to overall 40 years of imprisonment, 2 years in exile and 2 years banned from traveling from Iran as complementary punishment by branch 35 of Razavi Khurasan Appeal Court for the accusation of “being members in anti-regime groups to disturb national security, Propaganda against Islamic Regime, establishing and managing channel in Telegram messenger to disturb national security”. The sentence was delivered orally to their lawyer after him being summoned to the court. This sentence was issued under article 450 of Islamic Penal Code and trial was held in absence of the plaintiffs and their lawyer, the appeal court has also approved the sentence in 1 day, without their presence. Due to article 134 of the Islamic Penal Code, the maximum punishment will be executed to each one of these 4 activists.
An informed source in contact with Human Rights in Iran mentioned: “Hashem Khastar is sentenced to 5 years imprisonment for membership in groups against Islamic regime to disturb national security, 1 year for propaganda against Islamic Regime, 10 years for establishing and managing a channel in Telegram Messenger to disturb the national security, and 2 years exile to Nikshahr and banned from traveling out of Iran as complementary punishment. Mohammad Nourizad is sentenced to 7 years and 6 months imprisonment for membership in groups against Islamic regime to disturb national security, 1 year and 6 months for propaganda against Islamic Regime, Insulting Supreme leader in 2 cases, 3 years for each one according to article 514 of Islamic Penal Code, and 2 years exile to Izeh and banned from traveling out of Iran as complementary punishment. Mohammad Hossein Sepehri is sentenced to 1-year imprisonment for Propaganda against the Islamic Regime, 5 years for membership in groups against the Islamic regime to disturb national security. The other civil activist convicted in this case, Fatemeh Sepehri, for membership in groups against the Islamic regime to disturb national security is sentenced to 32 months imprisonment and 8 months for propaganda against Islamic Regime.”
This informed source added: “Mohammad Nourizad, Hashem Khastar, Mohammad Hossein Sepehri, and Fatemeh Sepehri are all accused of »Disturbing public order and security« and also »Insulting supreme leader through publishing messages in social media« in another case and are summoned to attend the court on April 10th, 2020 in Secon-Class Criminal Court of Mashhad and these activists and their lawyers are looking forward to that date.”
This source added: “on March 18th, 2020 a text message was sent to one of the lawyers in the case to refer to the 35th branch of the appeal court to deliver the decision to the lawyer, but the judge had mentioned no decision had been made yet due to the fact that the case was not read and examined, but surprisingly when they went to the court on March 29th, the date of the sentence was a day after that, i.e. March 19th, 2020.”
It is also notable that on March 2nd, 2020 Hashem Khastar, Mohammad Nourizad, and Fatemeh Spepehri had been convicted in the lower court of Mashhad Revolutionary court branch 4 under supervision of Judge Hadi Mansouri to 69 years imprisonment, also Mohammad Nourizad and Hashem Khastar was sentenced to 3 years in exile and banned from traveling out of Iran.
On January 19th, 2020 Mohammad Hossein and Fatemeh Sepehri, two of the 4 mentioned civil activists currently kept in Vakil Abad Prison in Mashhad had been tried in branch 4 of Mahshahd Revolutionary Court under supervision of Judge Hadi Mansouri in presence of their lawyer, Mohammad Hossein Aghasi, for the political and security accusations and their defenses were delivered to the court by their lawyer.”
The day before that on January 18th, 2020, Mohammad Nourizad and Hashem Khastar, two other defendants in the had been tried in the same court by the same judge and their defenses were delivered by their lawyer, while they insisted on their points of views.
On December 22nd, 2019 Human Rights in Iran had issued news in this regard in which indicated that Mashhad Revolutionary and public Attorney Office number 903 had explained the accusation to the aforementioned civil activists and the case was referred to the branch 4 of Mashhad Revolutionary Court under Supervision of Judge Hadi Mansouri.
The punishments are delivered while Khamenei insisted in the Islamic Republic no one is tried or punished because of criticizing him or the Islamic Regime and there is no political prisoner, while Raeesi, Head of Judiciary System, Last week in Islamic Human Rights Center of Judicial System has announced that Islamic Republic in the highest compliance with the measures of UDHR.
